Mutual of Omaha Forced to Revise Practices

The U.S. District Court for the District of Massachusetts forced the hand of insurance company Mutual of Omaha after investigation began on their decision to decline applicants whom are on the medication Truvada as pre-exposure prophylaxis for HIV (also known as PrEP). Mutual of Omaha was being investigated by the Massachusetts Attorney Generals office and being sued by GLBTQ Legal Advocates & Defenders (GLAD) before their denials were overturned in court. As reported by the Massachusetts Attorney Generals office, Mutual of Omaha “has revised its underwriting practices to ensure that it does not deny, rate, or otherwise take any adverse action against any Massachusetts resident who applies for any type of accident, life, sickness, or health insurance with Mutual of Omaha, including long-term care insurance, based on the applicant’s use of Truvada for PrEP.”
